Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and UnboundBytes ("UnboundBytes," "we," "us," or "our"). By accessing or using the UnboundBytes platform ("Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of Service

UnboundBytes provides a multi-tenant control plane for self-hosted software-as-a-service applications. The Service includes a web portal, API backend, agent software, and related tools for managing deployments, devices, and applications on your own infrastructure.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at security@unboundbytes.com if you suspect unauthorized access.

4. Acceptable Use

You agree that you will not:

• Use the Service in violation of any applicable law or regulation.
• Interfere with or disrupt the Service, its infrastructure, or other customers.
• Attempt to gain unauthorized access to other users' accounts, data, or tenants.
• Use the Service to distribute malware, phishing content, spam, or illegal content.
• Reverse-engineer, decompile, or circumvent the security of the Service, except where permitted by law.
• Resell or rebrand the Service without a written reseller agreement.

You are responsible for the security of the agent software installed on your infrastructure and for any applications you deploy through the Service.

5. Billing and Payments

Paid subscriptions are sold and processed by Paddle, who acts as the merchant of record for UnboundBytes. Paddle handles invoicing, payment processing, sales tax, VAT, and GST collection on our behalf. Subscriptions are billed in advance on a monthly or annual basis.

Prices are listed on our pricing page and may change with 30 days' notice. Refunds are handled on a case-by-case basis and are subject to Paddle's refund policy. Non-payment may result in service suspension or downgrade to the free tier.

6. Data Ownership

You retain all ownership rights to your data. UnboundBytes does not claim ownership of any content, configurations, or data you store or process through the Service. We access your data only as necessary to provide and improve the Service, as described in our Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. Where a formal service-level agreement (SLA) applies to your subscription tier, it is set out in the pricing page and the Master Subscription Agreement applicable to that tier.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE AGAINST EVERY POSSIBLE ATTACK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNBOUNDBYTES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to indemnify and hold UnboundBytes harmless from any claim, loss, or demand (including reasonable attorneys' fees) arising from your use of the Service, your applications deployed through it, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate this agreement at any time. You may cancel your account through the portal settings. We may suspend or terminate access for material violations of these Terms. Upon termination, your data will be retained for 30 days to allow export, after which it will be permanently deleted.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country of residence.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
